1. Booking & Payment
A signed agreement and retainer fee are required to secure your session date. The retainer is non-refundable and will be applied toward the total balance. The remaining balance is due on or before the session date unless otherwise agreed upon in writing.
2. Cancellation & Rescheduling
Clients must provide at least 48 hours’ notice for rescheduling. Retainers may be transferred to a new date at the photographer’s discretion. No-shows or last-minute cancellations may result in forfeiture of the retainer.
3. Session Coverage
J.R. Tolley Photography will make every reasonable effort to capture requested images but cannot guarantee specific poses, locations, or outcomes due to variables such as weather, lighting, and subject cooperation.
4. Turnaround Time
Final edited images will typically be delivered within [insert timeframe, e.g., 7–14 business days] after the session. Delivery timelines may vary during peak seasons.
5. Image Delivery
Images will be delivered via an online gallery or digital download. It is the client’s responsibility to download and back up all images upon delivery. Professional-quality prints may be ordered directly through J.R. Tolley Photography or its designated lab to ensure accurate color, clarity, and longevity. 6. Editing & Style
Clients acknowledge that they are familiar with the photographer’s style and agree that images will be edited accordingly. Additional edits or retouching requests may incur extra fees.
7. Copyright & Usage
All images remain the property of J.R. Tolley Photography (see Ownership of Work Section). Clients are granted a personal-use license to print and share images. Images may not be altered, sold, or used for commercial purposes without written permission.
8. Model Release
By booking a session, the client grants J.R. Tolley Photography permission to use images for portfolio, website, social media, and marketing purposes unless otherwise requested in writing prior to the session.
9. Liability
J.R. Tolley Photography is not responsible for any injuries, damages, or losses incurred during the session. In the unlikely event of equipment failure or unforeseen circumstances, liability is limited to the return of payments received.
10. Weather Policy
Outdoor sessions may be rescheduled due to inclement weather at the J.R. Tolley Photography's discretion to ensure the best possible results.
11. Print Products
Prints and products are produced through professional labs. J.R. Tolley Photography is not responsible for the quality of prints made through third-party vendors.
12. Cooperation
The client agrees to arrive on time and participate fully. Delays may result in reduced session time without refund.

Ownership of Work
J.R. Tolley Photography retains all right, title, and interest in and to all photographs and Work Product created in connection with the Services, including all copyrights.
Client (on behalf of itself and any attendees) grants J.R. Tolley Photography and its service providers a perpetual, royalty-free, worldwide, irrevocable, transferable, and sublicensable license to use any materials provided or created by Client or attendees during the performance of the Services. This includes use in J.R. Tolley Photography portfolio, studio display, website, social media, marketing, advertising, and promotional materials, in any format or medium, now known or later developed.
Client represents and warrants that it has the full right and authority to grant this license and that no third party rights will prevent such use.
Personal Use License
J.R. Tolley Photography grants Client a limited, non-exclusive, perpetual, irrevocable, royalty-free, non-transferable, and non-sublicensable license to use the Work Product for personal, non-commercial purposes (“Personal Use”).
Personal Use includes, but is not limited to:
· Posting images on personal social media accounts
· Printing images for personal display (home, office, etc.)
· Creating albums, wall art, or personal gifts
· Sharing images with family and friends (including holiday cards, emails, etc.)
Client agrees not to:
· Sell, license, or profit from the images in any way
· Use images for business, marketing, or promotional purposes
· Enter images into contests or publications without written permission
· Alter images beyond basic cropping without prior approval
· Remove watermarks, logos, or copyright notices (if present)
· Commercial Use
